La Cour d'appel confirme le jugement du tribunal de première instance

Affaire Achraf Diwane contre le laboratoire Smithkline Beecham
Joie et soulagement étaient au rendez-vous pour la famille Diwane suite à l'annonce, lundi, du dernier verdict par la Cour d'appel. Il est, par contre, tombé comme un couperet sur la tête du laboratoire Smithkline Beecham condamné à payer 3 millions de dirhams de dommages et intérêts au petit Achraf.
En fait, la Cour d'appel ne fait que confirmer le jugement de première instance prononcé fin 2005 et qui a constitué une jurisprudence dans l'histoire de la justice marocaine. En affirmant la responsabilité du géant pharmaceutique dans l'invalidité de la victime, aujourd'hui handicapée à 100 % par une tétraplégie, le tribunal condamne, par la même, le très controversé vaccin Engerix B contre l'hépatite B. La relation de causalité entre ce dernier et l'état de la victime est bel et bien existante.
Abdellah Diwane, père de la victime, considère que la décision du tribunal est équitable. «Je salue le courage des juges qui ont décidé de sauver mon fils en condamnant le laboratoire à payer des dommages et intérêts qui me permettront de financer ses soins à l'étranger. Il est vrai que n'importe quelle somme d'argent, aussi importante soit-elle, ne sera jamais à la hauteur de ma perte et des dommages subis par mon enfant.
Quand il est né, j'ai porté tous mes espoirs sur lui. Je rêvais de le voir grandir devant moi, et au lieu de cela, je suis témoin de sa souffrance et de sa décadence jour après jour.» Pour sa part, l'Association marocaine des droits humains voit en ce dénouement une fin heureuse parce qu'elle rend justice à la famille Diwane, quoique sa perte est trop lourde pour qu'elle puisse être réparée. L'AMDH espère, par la même, que les autorités gouvernementales interviennent pour prêter main forte à la victime afin de bénéficier des soins adéquats. La même instance a affirmé qu'elle aurait aimé que les deux parties parviennent à un arrangement à l'amiable au lieu de faire traîner le procès dans les tribunaux.
Après que la justice ait dit son dernier mot, le père de Achraf n'a qu'un seul souhait; que les formalités d'exécution soient entamées dans les plus brefs délais. D'ailleurs l'avocat de la famille s'attelle déjà à la tâche.
Toutefois, il est un peu tôt pour la famille Diwane de crier victoire. Le laboratoire Smithkline Beecham refuse de baisser les bras et entend continuer à se battre en portant l'affaire à la Cour suprême. Affaire à suivre…
